1. Membership, Accounts & Child Artist Program

Welcome to GNOAS (gnoas.com). By accessing or using our website, 3D and Virtual Galleries, Membership services, Artist Directory, or Marketplace, you agree to be bound by the following Terms of Service. Please read them carefully.

• Age Eligibility: Users must be at least 18 years old to register an account, apply for membership, or engage in standard platform transactions.
• Child Artist Program:
  • Children under 18 do not need to create an individual account.
  • Selected artwork by child artists may be published, exhibited, and made available for sale on the platform.
  • Recognized child artists will be issued a digital Child Artist Card.
• Member Cards: Verified members will be issued an official Member Card.
• Account Suspension & Termination: GNOAS reserves the right to suspend or permanently terminate any account or membership if the user violates platform policies or guidelines.

2. Virtual Gallery & Exhibitions

• Exhibition Opportunities: Any artist or user can organize or participate in exhibitions hosted within the GNOAS Virtual Gallery.
• Gallery Fee: Hosting an exhibition is subject to a standard Gallery Fee.
• Member Benefits: Verified members are eligible for special conditions, discounts, or waived exhibition fees based on their membership tier.

3. Marketplace, Payments & Commission

• Platform Commission: GNOAS deducts a 5% service commission on all sales completed through the GNOAS Marketplace.
• Payment Processing: All buying drops, artworks, and service payments must be processed securely through GNOAS-approved payment gateways.

4. Refund & Cancellation Policy

• 24-Hour Refund Window: Buyers may request a full cancellation and refund for any buying drop or service payment within 24 hours of purchase.
• Fee Waiver: For orders canceled within the 24-hour window, all buying drop and service fees will be waived/refunded in full.

5. Intellectual Property, Copyright & Publicity

• Artwork Ownership: All original intellectual property rights and copyrights for artworks uploaded to the 3D Gallery, Virtual Gallery, or Artist Directory remain exclusively with the respective artist or creator.
• Publicity License: By submitting or uploading artwork to GNOAS, the artist grants GNOAS a worldwide, royalty-free license to display, promote, feature, and advertise the artwork across our website, virtual galleries, social media, and promotional platforms.

6. International Compliance (GDPR & DMCA)

• DMCA Notice & Takedown: GNOAS respects intellectual property rights. If you believe your copyrighted work has been improperly displayed on our platform, please submit a written DMCA notice to support@gnoas.com with proof of ownership for swift investigation and removal.
• GDPR Compliance: For international users, GNOAS adheres to global data protection regulations (GDPR). Users retain the right to request access to, correction of, or deletion of their personal data stored on our systems.

7. Prohibited Activities

Users are strictly prohibited from:

• Uploading stolen, plagiarized, or copyright-infringing artwork/content.
• Providing false, misleading, or fraudulent information.
• Engaging in unlawful activities, security breaches, or unauthorized platform tampering.

8. Limitation of Liability & Transactions

• Platform Transactions: For sales and agreements conducted directly through the GNOAS platform, GNOAS tracks transactions and accepts full responsibility for facilitating secure delivery and payment handling.
• Personal/Off-Platform Deals: GNOAS is not responsible or liable for any disputes, financial losses, or agreements made privately between buyers and artists outside of the official GNOAS platform.

9. Governing Law & International Jurisdiction

• Primary Governing Law: These Terms of Service are governed by and construed in accordance with the Laws of Bangladesh, alongside international data privacy and copyright standards (GDPR & DMCA).
• International Exhibitions: When GNOAS hosts virtual or physical exhibitions in countries outside Bangladesh, those specific events will also comply with the local laws, event regulations, and venue jurisdictions of the host country.
• Dispute Resolution: Any disputes arising under these Terms shall first be attempted to be resolved amicably through direct negotiation or international arbitration.
